Rural Insurance

What is Cycle Rickshaw Insurance?

Cycle Rickshaw Insurance is a rural insurance product by Probitas Insurance Brokers Ltd. (the insurer) providing comprehensive three-section cover for human-pedalled cycle rickshaws used for hire or reward. A critical and unique feature is Passenger Liability included under Section B, protecting the owner against legal claims from injured fare-paying passengers. Probitas Insurance Brokers Pvt. Ltd. (IRDAI Lic. No. 528) is your licensed broker.

🔑 Key Differentiator: Passenger Liability is Included in Section B

Unlike standard Pedal Cycle Insurance, this policy uniquely includes Passenger Liability under Section B (Third-Party) — covering the owner's legal liability for bodily injury or death of fare-paying passengers being carried for hire. Without this, a rickshaw accident injuring a passenger could result in significant personal financial liability. Always confirm this inclusion with Probitas at inception on 022 4302 0000.

⚠️

Note: This policy covers PEDAL cycle rickshaws only — NOT e-rickshaws

Electric / motorised e-rickshaws and battery-operated three-wheelers are not covered under this policy. For e-rickshaws, a separate Motor Insurance policy under the Motor Vehicles Act is required. Contact Probitas on 022 4302 0000 for e-rickshaw insurance guidance.

How Claims Are Calculated

IDV, Sum Insured & Claim Calculation

🛺 Own Damage (OD) Claims

For partial damage: actual repair cost minus depreciation on parts, minus ₹100 compulsory deductible. For total loss / theft: IDV minus ₹100 deductible is settled.

👥 TP + Passenger Liability Claims

Settled as per court / MACT determination. The insurer pays the assessed liability for third-party and passenger injury / death arising from use of the rickshaw — subject to policy terms.

🧍 Personal Accident (PA) Claims — Puller Only

PA claims settled as a % of the Capital Sum Insured (CSI) chosen at inception. Death and PTD: 100% CSI. Loss of one limb / eye: 50% CSI. Section C covers only the named puller — not passengers.

⚖️ Under-Insurance — Average Clause

If declared IDV is lower than actual market value at time of claim, the condition of average applies — OD claim reduced proportionally. Always insure at 100% of current market value.

Policy Conditions

Special Conditions

The following 12 conditions are binding under the Cycle Rickshaw Insurance Policy. Non-compliance may result in claim rejection or policy voiding.

1

The cycle rickshaw must be accurately described in the policy schedule — make/type, frame/registration number, IDV, and declared use (hire/reward or private).

2

IDV = agreed current market value at inception — cannot be altered during the policy period.

3

Any modification to the rickshaw (fitment, bodywork, seating) must be declared — undeclared modifications may void coverage for claims arising from those modifications.

4

The insured must take all reasonable steps to safeguard the rickshaw from loss or damage. Wilful neglect may void claims.

5

For theft claims: Police FIR is mandatory — must be lodged immediately. Non-traceable certificate from police required for total theft claims.

6

For OD claims: do not authorise repairs without prior insurer survey / approval for claims above the applicable threshold amount.

7

The rickshaw must be used only for the declared purpose (hire/reward or private). Undeclared commercial activities void the cover.

8

Section C (PA) covers ONLY the named rickshaw puller / owner-operator. It does NOT cover passengers — passenger liability is under Section B (TP).

9

Transfer of ownership: policy must be transferred to new owner within 14 days of sale. Failure to transfer voids coverage for the new owner.

10

The insurer reserves the right to inspect the rickshaw at any time during the policy period to verify declared details and condition.

11

Subrogation: on settlement of any OD or TP claim, all rights of recovery against responsible third parties are automatically transferred to the insurer.

12

Renewal: IDV is reassessed at each annual renewal based on the depreciation schedule. Vehicle condition must be re-declared to confirm current market value.

Some Myths about Cycle Rickshaw Insurance

Frequently Asked Questions

Cycle Rickshaw Insurance is a rural insurance product by the insurer providing three-section cover for human-pedalled cycle rickshaws used commercially. It is essential for any rickshaw puller or owner — it protects the vehicle against damage and theft (Section A), covers legal liability including passenger injury (Section B), and provides personal accident cover for the puller (Section C). Without it, a rickshaw accident could expose the owner to significant personal financial liability.
Yes — under the Motor Vehicles Act, Third-Party insurance is mandatory for any vehicle used on Indian public roads, including cycle rickshaws used for hire or reward. Operating a commercial rickshaw without at least a TP policy is illegal. Probitas recommends the comprehensive plan covering OD + TP (with Passenger Liability) + PA for complete protection.
Yes — this is the key differentiator. Passenger Liability is included under Section B (Third-Party Liability). If a fare-paying passenger is injured or killed while being transported, the insurer covers the owner's legal liability as assessed by a court or MACT. This is liability cover for the owner — not a personal accident benefit for the passenger. The passenger may claim compensation through the owner's TP policy.
IDV = current market value of the cycle rickshaw agreed at inception after depreciation. Example: A rickshaw bought for ₹15,000 that is 2 years old has an IDV of ₹15,000 × (1 − 20%) = ₹12,000. This is the maximum OD claim payable for total loss or theft. IDV is fixed at inception and cannot be changed mid-policy.
Yes — Section C (Personal Accident) covers the named rickshaw puller / owner-operator for: Death (100% CSI), PTD (100% CSI), Loss of two limbs/eyes (100% CSI), Loss of one limb/eye (50% CSI), PPD (per schedule). CSI chosen at inception. Important: Section C covers only the named puller — not passengers (who are covered under Section B's liability).
Yes — theft is covered under Section A (Own Damage). A Police FIR must be lodged immediately. A non-traceable certificate from police is required for total loss claims. Claim payable = IDV minus ₹100 compulsory deductible.
Flood damage is covered under Section A (Own Damage) — no Police FIR required.
Step 1: Call Probitas on 022 4302 0000 immediately. Do not attempt repairs.
Step 2: Insurer appoints a surveyor to inspect and assess.
Step 3: Submit Claim Form, Policy doc, surveyor report, repair bills, photos, bank details.
Claim settled at repair cost minus depreciation on parts, minus ₹100 deductible.
For a rickshaw that is 1 to 2 years old, the depreciation rate is 20%. A rickshaw purchased at ₹15,000 has an IDV of ₹15,000 × (1 − 20%) = ₹12,000 at the 2-year mark. At 2–3 years: 30% depreciation applies. At 3–4 years: 40%. This IDV is the maximum payable for total loss or theft.
Yes — second-hand and older rickshaws can be insured. IDV is based on current market value after applicable depreciation. For rickshaws over 5 years old, IDV is mutually agreed between insurer and insured. Frame / registration number and purchase details must be accurately declared at inception.
